Water plant intake lines for the city of Toledo, Ohio, pass through a privately operated hazardous waste disposal site. Safeguards were negotiated with operators of the disposal site to protect the intake lines from possible contamination. The security agreement was accomplished outside of regulatory processes since there were no specific federal, state, or local regulations covering the situation. The agreement with landfill operators covers the following: waste area locations; water line easement survey and boundary monument installation; waste area design and construction criteria; installation of monitoring trenches; site inspections and provisions for termination of the agreement.
